How much is my case worth? That’s a question I am always asked and one that clients always want to know. How much an automobile accident case is worth is not an easy question to answer. Every case is different and there are many factors that determine the value of a car wreck case.

The Extent of the Injury

The most obvious factor is the extent of the injury. A person who has suffered a broken bone in a car wreck is generally entitled to greater compensation than someone with a less serious injury. Documenting bruising or cuts and lacerations with photographs can be indisputable evidence of how bad you were hurt and very convincing.

Was your Wreck Serious?

Insurance Companies also like to look at the type of wreck. Was it a minor impact, soft tissue wreck? These types of wrecks are sometimes referred to by their acronym as MIST cases and can be difficult if you do not have a skilled attorney in your corner willing to fight for you.

How Much Damage was done to your Car?

If you are in a car wreck with a lot of damage to the vehicles involved, photographs of the damage can be tremendous evidence. Photographs taken at the scene itself are very helpful. Even photographs taken later can help when negotiating a claim with an insurance adjuster. If you’ve been in a bad wreck taking pictures with your smartphone at the scene not only helps show who may be at fault but can also help enhance the value of a claim.

My Medical Expenses

The amount of your medical expenses can also have a bearing on how much an insurance company is going to pay on a particular claim. However, sometimes excessive treatment for a relatively minor injury can have an adverse effect. I like to advise my clients to see their doctor and listen to what he has to say but don’t continue to get medical treatment unless you need it.

The value of an automobile accident case is never a certainty. When cases go to trial both sides risk a jury verdict that they may not be pleased with but sometimes when an insurance company’s offer is well below what is acceptable a jury trial is necessary.
